Al entrar en la tienda, el guardia de seguridad recibi\u00f3 varios pu\u00f1etazos que le causaron lesiones que necesitaron 4 semanas para curarse. A continuaci\u00f3n, los tres hombres rompieron las vitrinas de cristal de la tienda y robaron 46 joyas y un expositor por un valor total de 106.273.000 yenes (equivalentes a unas 679.000 libras esterlinas).<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Sentencia<\/strong><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Los recursos del Gobierno de Jap\u00f3n se dirig\u00edan contra la decisi\u00f3n del Juez Superior de Distrito de sobreseer los procedimientos de extradici\u00f3n de Chappell y Wright. El juez, en cuatro decisiones distintas, consider\u00f3 que no hab\u00eda pruebas suficientes para iniciar un proceso contra el Sr. Chappell y sobresey\u00f3 a ambos hombres debido, entre otras cosas, a su preocupaci\u00f3n por los derechos humanos en Jap\u00f3n:<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">1.     Condiciones de las prisiones y centros de detenci\u00f3n y riesgo de malos tratos (art\u00edculo 3 del CEDH).<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">2.     La obligaci\u00f3n de realizar trabajos forzados se consider\u00f3 una infracci\u00f3n del art\u00edculo 4 del CEDH.<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">3.     Que no hubo fianza disponible durante los primeros 23 d\u00edas de detenci\u00f3n, lo que supuso una violaci\u00f3n del art\u00edculo 5 del CEDH.<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">4.     El hecho de que el sistema de justicia penal japon\u00e9s no permitiera la presencia de abogados en la sala de interrogatorios y otras cuestiones que daban lugar a un riesgo real de denegaci\u00f3n flagrante de justicia (art\u00edculo 6 del CEDH).<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>El Tribunal Divisional revoc\u00f3 las decisiones del Juez Superior de Distrito y declar\u00f3:<\/strong><\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">1.     Que se aportaron pruebas suficientes contra el Sr. Chappell para un caso que responder.<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">2.     Que las garant\u00edas dadas por el Gobierno japon\u00e9s eran suficientes a efectos del art\u00edculo 3 del CEDH para prevenir el riesgo de malos tratos o malas condiciones.<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">3.     Que no exist\u00eda riesgo real de vulneraci\u00f3n del art\u00edculo 4 del CEDH, ya que no hab\u00eda riesgo de trabajo forzoso.<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">4.     Que no exist\u00eda un riesgo real de violaci\u00f3n del art\u00edculo 5 del CEDH, ya que no hab\u00eda riesgo de detenci\u00f3n arbitraria.<\/p>\n<p style=\"margin-left:40px;white-space:pre-wrap;\" class=\"\">5.     Que, a la luz de las nuevas garant\u00edas ofrecidas por el Gobierno de Jap\u00f3n en apelaci\u00f3n en relaci\u00f3n con el derecho de acceso a un abogado y el derecho al silencio, no exist\u00eda un riesgo real de violaci\u00f3n flagrante del art\u00edculo 6 del CEDH.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">El demandado puede solicitar al Tribunal Superior que certifique una cuesti\u00f3n de importancia p\u00fablica para que sea examinada por el Tribunal Supremo.
